Minutes of Meeting
March 1, 2007


A regular meeting of the Salem Planning Board was held on Thursday, March 1, 2007, in the third floor conference room at 120 Washington Street, Salem, Massachusetts at 7:00 p.m.

Those present were: John Moustakis, Gene Collins, Tim Kavanagh, Chuck Puleo, Pam Lombardini, Nadine Hanscom and Christine Sullivan. Also present were Staff Planner Dan Merhalski, and Ian Fullerton, Clerk.

Members Absent: Walter Power, Timothy Ready

Approval of Minutes

Mr. Puleo reviewed the minutes for the Planning Board meeting held on February 15th, 2007.

There being no questions or comments regarding the matter at this time, a motion was made by Ms. Sullivan to approve the minutes, seconded by Mr. Moustakis, and approved (7-0).


Continuation of Public Hearing – Drive Through Facilities Special Permit and Site Plan Review Special Permit – Tri-City Sales and CVS Pharmacy – 262-272 Ave. (Map 8, Lots 99, 100, 104, 105) – Joseph Correnti

Mr. Correnti, representing Tri-City Sales and CVS Pharmacy, requested that the public hearing be continued on March 15th, 2007. Mr. Correnti cited that the developers had re-filed, with the same site plan, and on March 15th 2007 the hearing could be started anew with all members of the Planning Board present. Mr. Correnti stated that the previous site plan would be withdrawn and the new site plan would begin review on March 15th, 2007.

Mr. Collins asked if the developers had paid a fee for re-filing. Mr. Correnti stated that the fee to re-file had been waived by the City.

There being no further questions or comments regarding the matter at this time, a motion was made by Mr. Collins to continue the public hearing on March 15th, 2007, seconded by Ms. Lombardini, and approved (7-0).

Form A – Approval Not Required Plan – 22-24 Webb Street (Map 41 Lots 233, 234) – Joseph Correnti

Mr. Correnti addressed the Planning Board in regards to an Approval Not Required Plan for 22-24 Webb Street. He explained that the owner had gone before the Board of Appeals, and that the requested subdivision had been approved, granting the necessary relief for the two lots, as shown on the plan presented to the Planning Board.

Mr. Puleo noted that when the Board of Appeals waived requirements such as frontage, area, etc, it is as though the lots are conforming, when brought before the Planning Board.

There being no further questions or comments regarding the matter, a motion was made by Ms. Sullivan to endorse the Approval Not Required (ANR) plan, seconded by Mr. Collins, and approved (7-0).

Public Hearing – Amendment to Previously Approved Definitive Subdivision Plan – Glover Estates , LLC – 485 Lafayette Street (Map 31, Lot 237) – George Atkins

Mr. Atkins, representing Glover Estates, LLC, addressed the Planning Board in regards to an Amendment to a Previously Approved Definitive Subdivision Plan for 485 Lafayette Street. Mr. Atkins requested that the public hearing be continued on March 15th, 2007, citing that notices for the hearing had not been sent to abutting residents.

There being no further questions or comments regarding the matter, a motion was made by Mr. Collins to continue the public hearing in March 15th, 2007, seconded by Ms. Lombardini, and approved (7-0).


Discussion/Vote –Traffic Light Installation Conditions – Osborne Hills Realty Trust – 57 Marlborough Road (Map 9, Lot 1) – Brian McGrail

Mr. McGrail was not present at the meeting. Mr. Merhalski explained that the applicant had requested a condition of the previously approved subdivision plan be waived in order to allow the developer to be issued 10 Certificates of Occupancy before the traffic signal was fully installed and operational.

Ms. Sullivan stated she would only approve the condition be waived one time.

Mr. Puleo inquired as to the status of the paving for the project. Mr. Merhalski stated that the pavement for the section of the first ten houses would only be through the first binder course at the time of the Certificates of Occupancy being issued. Mr. Puleo stated that he would prefer that the first section of paving be finished by the time the traffic signal was installed.

Mr. Moustakis noted it was good that the developer was ahead of schedule, citing the issue of traffic congestion in regards to the Tri-City Sales project on Marlborough Road.

Mr. Kavanagh noted that it would be a priority of the city to install the light as soon as possible, citing that nine of the ten houses had already been bought before construction had begun.

There being no further questions or comments regarding the matter, a motion was made by Mr. Collins to grant the developer up to 10 Certificates of Occupancy prior to the traffic signal’s installation, seconded by Ms. Lombardini, and approved (7-0).

There being no further business to come before the Planning Board this evening, a motion was made by Mr. Collins to adjourn the meeting, seconded by Mr. Kavanagh, and approved (7-0).

The meeting was adjourned at 7:45 p.m.
